Terms of Use

1. Who we are and what this agreement covers

These Terms of Use (the "Terms" or "EULA") are a legal agreement between you and BringIt LG, LLC ("BringIt", "we", "us"). They govern your use of the ChubbyPuppy application for iPhone and Apple Watch, its widgets and extensions (together, the "App"), and the website at chubbypuppy.ai (the "Site"). By downloading, installing or using the App, or by using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App or the Site.

2. Acknowledgement regarding Apple

The App is distributed through the Apple App Store. You acknowledge that these Terms are concluded between you and BringIt only, and not with Apple Inc. ("Apple"). BringIt, not Apple, is solely responsible for the App and its content. Your use of the App must also comply with the Usage Rules set out in the Apple Media Services Terms and Conditions.

3. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian, and only a person of legal age may purchase a subscription. ChubbyPuppy is a lifestyle and habit game and is not intended for anyone who has been diagnosed with, or is at risk of, an eating disorder. If tracking food or weight is difficult for you, please talk to a healthcare professional before using calorie or weight features.

4. License

Subject to these Terms, BringIt grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules, including through Family Sharing where enabled. The App is licensed, not sold, to you. Except as expressly allowed by these Terms or by law, you may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile or attempt to extract the source code of the App, or create derivative works from it. All rights not expressly granted are reserved by BringIt.

5. Not medical advice

ChubbyPuppy provides general wellness, activity and nutrition information for entertainment and motivational purposes only. It is not a medical device and does not provide medical, nutritional or psychological advice, diagnosis or treatment. Calorie, macronutrient and portion estimates produced by the App's AI features are estimates and may be inaccurate. The AI coach characters are fictional personalities, not licensed professionals. Always consult a qualified healthcare provider before starting a diet or exercise program, and never disregard professional advice because of something in the App. If you experience pain, dizziness or other symptoms while exercising, stop and seek medical help.

6. Apple Health

With your permission, the App reads activity, energy, step, workout and body-mass data from Apple Health and writes nutrition data from meals you scan back to Apple Health. You control this access in the Health app and in iOS Settings at any time. We use Apple Health data only to provide the App's features, as described in our Privacy Policy. We never use it for advertising or sell it.

7. Premium, subscriptions and purchases

ChubbyPuppy has a single Premium tier. You can preview onboarding and choose your buddy without paying, but using the App beyond onboarding requires an active Premium purchase, and if your access lapses the App will ask you to renew. Every Premium plan unlocks the same features: all nine buddies, unlimited treat scans and Snack Court verdicts, the interactive puppy, the Den and AR play, fitness and nutrition tracking, progression and gear, the AI coach, sharing features, and the Apple Watch, widget and Live Activity companions. Legendary Forms are included but must still be earned by reaching their weight-loss milestones; paying does not complete a milestone.

Premium is offered as (US prices as of the date above; Apple supplies localized prices in other regions):

• Annual — $39.99 per year, auto-renews every 12 months. Starts with a 3-day free trial for eligible customers. This is the default option.
• Weekly — $4.99 per week, auto-renews every 7 days. No free trial.
• Lifetime — $79.99, a one-time purchase that does not renew.

Prices are shown in the App before you buy and may change over time. Payment is charged to your Apple ID account at confirmation of purchase.

Auto-renewal and cancellation

Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings (Settings → your name → Subscriptions on your iPhone). Deleting the App does not cancel a subscription.

Free trials

If you start a free trial, you will be charged the subscription price when the trial ends unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are available to new Premium subscribers only, and eligibility is determined by Apple.

Refunds, restoring and codes

All purchases are processed by Apple and are subject to Apple's refund policy. Requests for refunds must be made to Apple. You can restore previous purchases from the App's Premium screen. Offer codes and promotional pricing may carry additional terms and may be withdrawn at any time.

8. Your content

Photos you scan, the name you give your puppy and captions you write are yours. You grant BringIt and its service providers a limited license to process that content solely to provide the App's features to you, for example sending a meal photo to an AI model to estimate its nutrition. Do not scan images that contain other people, private information or content you have no right to use.

9. Acceptable use

You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to our systems or those of our providers; interfere with the App's operation, security or anti-fraud features; use automated tools to access the App; attempt to manipulate AI features into producing harmful content; or use the App in a way that could harm minors. We may suspend or terminate access for violations.

10. AI features

The App uses artificial intelligence, including on-device Apple Intelligence models and cloud-hosted models operated by Google, to recognise food, estimate nutrition, generate coach conversations and write short in-character messages. AI output can be wrong, incomplete or inappropriate despite our safeguards. Use your judgement, and do not rely on AI output for health decisions. 11. Intellectual property

The App, the Site, the ChubbyPuppy name and logo, the puppy characters, Legendary Forms, artwork, 3D models, animations, text, sounds, software and all related intellectual property are owned by BringIt or its licensors and are protected by copyright, trademark and other laws. Nothing in these Terms gives you any right to use our trademarks. If you send us feedback or ideas, you grant us a perpetual, royalty-free license to use them without obligation to you.

12. Third-party services and terms

The App relies on third-party services, including Apple (App Store, HealthKit, Apple Intelligence, Sign in with Apple), Google (Firebase and the Gemini model used for food recognition) and RevenueCat (subscription management). Your use of those services may be subject to their own terms, and you agree to comply with any applicable third-party terms when using the App.

13. Maintenance and support

BringIt is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish maintenance or support services for the App. For help, email hello@chubbypuppy.ai.

14. Warranty disclaimer

To the maximum extent permitted by applicable law, the App and the Site are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or that AI estimates will be accurate.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are BringIt's sole responsibility.

15. Product claims

BringIt, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of HealthKit.

16. Intellectual property claims

If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, BringIt, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.

17. Legal compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Limitation of liability

To the maximum extent permitted by law, BringIt and its members, officers, employees and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the App or the Site, even if advised of the possibility. Our total liability for all claims relating to the App or the Site will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow these limitations, so they may not apply to you.

19. Indemnity

You agree to indemnify and hold harmless BringIt from any claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

20. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including 5, 11, 14–19 and 21–23) will survive.

21. Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

22. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida and the United States, including the Federal Arbitration Act, without regard to conflict-of-law rules. Nothing in this section limits any rights you have as a consumer under mandatory local law.

Informal resolution first

Before starting arbitration or a court case, the party raising a dispute must send the other a written Notice of Dispute describing the claim and the relief requested. Send yours to BringIt LG, LLC, 936 SW 1st Ave #240, Miami, FL 33130, or to hello@chubbypuppy.ai. If we cannot resolve the dispute within 30 days of the Notice, either party may begin arbitration.

Binding individual arbitration

Except for claims that qualify for small-claims court and claims for injunctive or other equitable relief, all disputes arising out of or relating to these Terms or the App will be resolved by binding arbitration on an individual basis, administered by JAMS under its rules in effect at the time (Streamlined Rules for claims under USD $250,000, Comprehensive Rules otherwise). You may choose to have the arbitration conducted by telephone, on written submissions, or in person where you live or at another agreed location. The arbitrator has exclusive authority to decide the scope and enforceability of this section, and judgment on the award may be entered in any court of competent jurisdiction.

Class-action and jury waiver

YOU AND BRINGIT AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND YOU BOTH WAIVE THE RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a particular claim, that claim will proceed in court, and the state or federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction.

30-day right to opt out

You may opt out of this arbitration agreement by emailing hello@chubbypuppy.ai within 30 days of first accepting these Terms, stating your name and that you want to opt out of arbitration. Opting out does not affect the rest of these Terms. This section survives termination, and if we make a material change to it you may reject the change by emailing us within 30 days of the change taking effect.

23. General

These Terms, together with the Privacy Policy, are the entire agreement between you and BringIt regarding the App and the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. We may update these Terms from time to time; material changes will be announced in the App or on the Site, and continued use after the effective date means you accept the updated Terms.
